Concerning non-disclosure and protection of intellectual property rights:
Chalk & Wire Learning Assessment Inc. and each client institution (institution) affirms and will take appropriate steps to protect the intellectual property rights of the other. Specifically, the institution retains all intellectual property rights in relation to faculty or staff inputs made to the Chalk & Wire Assessment Platform for the purposes of learning assessment, institutional self-study and on-going improvement. This includes but is not limited to all institutionally derived content inputted to create the data collection environment for end users, instructions, materials, assessment comments/annotations, iterations of submitted learner work samples as well as the resultant system raw data, statistical and other reports derived therefrom. The creators of assessed work samples retain intellectual property rights to the content they create and submit for assessment as well as files and content uploaded for the purpose of generating personal ePortfolios to which the institution has no access. Chalk & Wire retains all intellectual property rights in the Chalk & Wire Assessment Platform and its successive revisions (computer code) and software constructs and innovations developed or implemented by Chalk & Wire that represent and deliver assessment concepts resulting from research and development undertaken by Chalk & Wire. Officials of the institution or its designees, may discuss and access products for the purposes of testing and providing feedback to Chalk & Wire about new features and enhancement. Features enhanced or developed at no fee as a result of incidental or direct suggestions offered by any user are also the property of Chalk & Wire. Institutions are prohibited from revealing the work of Chalk & Wire software research and development in any manner with any entity that might reasonably be expected to develop similar software for either commercial or noncommercial purposes.
FERPA/PIPEDA/The Privacy Act & other prevailing privacy legislation
Chalk & Wire understands that the institution is subject to either FERPA (USA- Family Educational Rights and Privacy Act), or PIPEDA (Canada- Personal Information Protection and Electronic Documents Act, and The Privacy Act), or The Privacy Act (Australia) or any other prevailing State/Provincial or Federal/national privacy legislation. Chalk & Wire abides by all applicable legal regulations of these Acts in force in the nation wherein the client/institution resides. Specifically, where institutions are concerned, Chalk & Wire is considered an official of the institution as regards the protection of user and institutional data. As an official of the institution, Chalk & Wire must protect the privacy of all user data provided by the institution/users and shall not transmit, share, or disclose any data about end users without their written consent, except to other officials of the institution with a legitimate interest (i.e. the institutional official must seek the information within the context of his/her professionally assigned responsibilities with the institution and the information must be used within the context of official business of the institution).
Chalk & Wire only collects minimum user information for the account profile (first name, last name, email address) and if users choose to add more PII to their personal profile it is never visible to Chalk & Wire employees (support, admin or technical). Access to server files, databases, assessment and portfolio data is restricted to those employees who are necessary to perform their duties/responsibilities when requested by the client institution.
Security and Access to Data
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Chalk & Wire provides and enforces encryption for all data in transit (2048 bit SHA-1 SSL) including our integration system ensuring your information is transmitted to us in a secure way. You can verify this by looking for “https” at the beginning of the address of the web page. Your browser will also display a closed lock icon which can provide more detailed information about the certificate. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. The hosting provider which Chalk & Wire partners with uses unmarked locations with single secure entrances for customers and staff. Two-stage authentication process – Biometric (retinal scan) and then buzz-through recognition given proper ID leading to individually locked doors and cabinets. Networked security cameras (low-light technology) scan and record the interior and exterior of the facility 24x7. Key certifications include PCI DSS, ISAE 3402 Type II, SSAE 16 SOC 1 Type II and CSAE 3416 Type II.
While your institution is a client of Chalk & Wire, and/or your account has not been terminated for any other just cause, you may do the following at any time by logging into your account and choosing ‘My Profile’ after clicking on your name in the top right corner of any screen.
- See what profile data is listed.
- Change/correct any data.
- Delete any data (excluding first name, last name and email address).
- You may opt out of receiving updates from Chalk & Wire at any time by choosing ‘Unsubscribe’ at the bottom of newsletter or announcement emails.
Session cookies, also called transient cookies, are implemented to improve the user experience while using our sites. A session cookie is stored in temporary memory and is not retained after the browser is closed. User sessions also time out at a server level after a chosen period of nonuse set by a local administrator as a global policy for the entire institutional site. Standard cookies are only used for caching menu items in specific UIs. Usage of either cookie type is in no way linked to any personally identifiable information on our sites.
